Opinion:
กฎหมายไม่ควรกลายเป็นเครื่องมือผูกขาด “ฆ่าคนกัญชา”
แทนที่รัฐจะใช้กฎหมายเป็นเครื่องมือสนับสนุนประชาชนให้มีอาชีพ มีทางเลือก และสร้างเศรษฐกิจฐานราก กลับใช้วิธีออกกฎซับซ้อน ซ่อนเงื่อนไข และตีกรอบจนคนธรรมดาแทบไม่สามารถเข้ามาประกอบกิจการกัญชาได้เลย
ในเมื่อ “กัญชา” ถูกถอดออกจากยาเสพติด และเปิดให้ปลูก ใช้ ขาย ได้อย่างเสรีในระดับหนึ่ง รัฐควรใช้โอกาสนี้ในการ ออกแบบระบบควบคุมอย่างมีเหตุผล โดยตั้งอยู่บนฐานของ “ความปลอดภัยของผู้บริโภค” ไม่ใช่เพื่อกีดกันให้เหลือแต่กลุ่มทุนไม่กี่กลุ่มเท่านั้นที่ครอบครองผลประโยชน์ระดับแสนล้านบาทต่อปี
หลักการง่าย ๆ ที่รัฐควรทำ:
- อนุญาตให้คนทั่วไปสามารถ ลงทะเบียนเป็นผู้ขายหรือผู้ปลูกได้ง่าย
- มีระบบ ตรวจสอบคุณภาพและความปลอดภัย ของผลผลิตก่อนวางขาย เช่นเดียวกับอาหาร ยา หรือแอลกอฮอล์
- ไม่ควรกำหนดว่าร้านขายกัญชาต้องเป็น “สถานพยาบาล” เพราะเป็นการตีกรอบให้เฉพาะคนบางกลุ่มที่มีทุนหรือเส้นสายเท่านั้นที่ทำได้
สำหรับผู้บริโภค:
ควรมีกฎหมายชัดเจนว่าอายุเท่าไหร่ถึงซื้อได้ ต้องมีใบแพทย์หรือไม่ และใช้ในสถานที่ไหนได้หรือไม่ได้ — อย่าทำให้กฎหมายกลายเป็นพื้นที่เทาๆ ที่คนใช้ไม่รู้ว่าผิดหรือถูกจนกลายเป็นช่องให้เจ้าหน้าที่ใช้ดุลพินิจเกินขอบเขต
แล้วในสามปีที่ผ่านมาเกิดปัญหาอะไรขึ้นบ้าง?
แทบไม่มีข่าวร้ายแรงจากการใช้กัญชาโดยตรง ไม่มีกรณี “ดูดแล้วคลั่งฆ่าคน” หรือ “เมาแล้วขับชนคนตาย” แบบที่เกิดจากสุราหรือยาบ้า ที่เห็นบ้างคือคนสูบในที่สาธารณะ (ซึ่งก็มีกฎหมายควบคุมอยู่แล้ว) กับการลักลอบส่งออก (ซึ่งต้องจัดการด้วยระบบศุลกากรและการค้าระหว่างประเทศ ไม่ใช่ใช้เป็นข้ออ้างกีดกันภายในประเทศ)
กฎหมายควรเป็นเครื่องมือสร้างสมดุล ไม่ใช่ตัดโอกาสคนจำนวนมากเพื่อเอื้อประโยชน์ให้คนไม่กี่คน
หากรัฐยังเดินหน้าผลักกฎหมายที่ยิ่งทำให้ “คนกัญชา” ถูกบีบออกจากระบบทีละขั้น ก็คงต้องถามว่า นี่คือการคุ้มครองประชาชน หรือเป็นการปูทางให้ทุนใหญ่ผูกขาดตลาดสมุนไพรพันล้านกันแน่?
